This Rental Agreement made is between and Kimos Rent a Car Inc and Landlord or Property Manager and Tenant

1) Use of Property: There will be NO business conducted on the premises. It is understood and agreed that this tenancy shall be STRICTLY PERSONAL. This reservation is for quiet residential vacation accommodations only. Therefore, parties’, rehearsal dinners, receptions, luaus, wedding ceremonies, etc. are not allowed. This is a non-smoking property. Use of any illegal drugs on the property or inside the house will be subject of immediate eviction and criminal prosecution.

2)“Day/Evening use”: visitation of invitees shall be limited to authorized guests and does not provide for “sleep-over” or camping on property. The Owner/Manager reserves the right to evict without delay any persons who cause damage to the property or violate the law or act contrary to any of the conditions of occupancy noted in this agreement.

3) This home is located in a peaceful and quiet neighborhood. Enjoyable for guest looking for a quiet vacation. Excessive noise may violate
the Maui County noise ordinances and may be grounds for immediate eviction. Quiet hours are from 8:00pm to 8:00am. Noise complaints are subject to local Law Enforcement intervention.

Additional Charges: Rates do NOT include daily maid service (unless noted), long distance telephone charges, excessive cleaning upon departure (i.e. upholstery shampooing, etc.), damages, Hawaii State and Transient Accommodation tax, currently at 13.42%. Maid service can be arranged at guest expense.
Outcleaning Charges: The out-cleaning charge is included in the rent based on the understanding that tenants will leave the house clean and tidy at departure (in the condition that they found it on arrival). Any extraordinary cleaning, or laundry resulting from a guest’s visit will be charged to the credit card authorized below as damage/security deposit.
Repairs: Owner/Manager reserves the right to enter the unit to inspect, make repairs or provide supplies. This right will not be abused and the owner will make every effort to give the tenant notice. Appliances, lights, any electronics, can be subject of mal function. Owner/Manager will do it’s best to send a repair services. In some cases parts have to be ordered and repairs can take longer than expected. Any malfunctioning will be not subject of rent refunds/discounts.
Included Services: Owner shall provide the following: Yard care, Water, Electricity, Telephone, High Speed Internet Connection (excluding long distance charges) and refuse disposal (excluding broken mast, boards, oversize cardboard boxes).
Garbage: Please empty trash daily to keep bugs away.
Additional Services: Housekeeping, maid service, cooks or any other services requested or initiated by Tenant shall be paid for by Tenant and not be the responsibility of either Owners or Agents Assignability
This Agreement is NOT assignable by the Tenant, nor may Tenant sublease the premises.Loss/Theft: Tenant acknowledges that the house should be locked whenever tenant is away from the house. The owner, agent or manager are NOT responsible for any loss of guest’s property as a result of theft or other damage caused by unauthorized entry to the house.
Reservation and Payment: Your reservation has been accepted, and will be held for 10 days. Payment of the applicable Rental deposit mustbe received within this period. No grace period will apply. Final payment, consisting of the remaining rental balance, applicable taxes along
with this Rental Agreement must be received 60 (90 days Holliday Season) days prior to arrival. Reservations within 60 (90 Holliday Season) days, full payment is due at the time of reservation.
Cancellation and Refunds: Cancellation of this reservation at any time may result in a cancellation fee and is subject of booking agents policy.
To protect against cancellations caused by certain unforeseen events, such as illness, we recommend guests purchase trip cancellation insurance.
This reservation may be cancelled by the owner, in the event of government action, natural disaster, or failure of prior guest to vacate as scheduled, property sold and liability shall be limited to the amount of monies paid to date on the account. Owner/Agent shall not be liable for other expensesincurred such as plane tickets, pre-paid rental car, etc. In the event of a hurricane or other cause of mandatory evacuation during tenants stay, rent will be refunded for the days tenants could not be accommodated.
Tenant acknowledge that the property has no license to operate as a vacation rental.The rental of said premises is contingent on ongoing tacit governmental approval, and it is understood that as in most vacation rental
situations across the county, this property does not have vacation rental zoning. In case this property will be taken out of the vacation rental inventory, owner/agent/manager shall not be liable for other expenses incurred such as plane tickets, pre paid rental car, etc.
Liability: By signing this agreement, tenant accepts total responsibility with respect to any accident or injury involving the pool , property or ocean. Tenants are advised to exercise due caution in the use and enjoyment of the property.
Tenants release and hold Owner, Manager and Agent harmless for any loss, injury, expense, damage, or claims resulting from their stay at this property.
Acknowledgement: Tenant acknowledges receipt of a duplicate copy of this Rental Agreement. Tenant acknowledges that he/she has read and understands and agrees to the terms and conditions of this rental agreement, and agrees to abide by all stated restrictions on use of the property. Tenant understands that he/she is executing this agreement on behalf of all persons renting.
